Political Science

D104 - 6 ECTS


The program aims to introduce the student to the study of the Politics in an interdisciplinar and mutildimensional perspective and intends to answer contemporary questions, without forgetting a strong formative component. It aims to provide these skills to future jurists, in the framing of the study subjects in the plan of studies and in the programs of the subjects that are similar, like Constitucional Law. The program studies political societies in general, and mainly the State, expressed in its constitutional rules. Thus, it is given importance to the State in history, and to the connections made visible with the Modern Public Law.
The influence of political institutions on the structure of society in the Western world has become increasingly evident.

Students should also be able to discuss current topics of political debate.

Constitutional Law I

Familiarize students with the basic foundations of the general part of constitutional law, and the basic structure of the Portuguese Constitution, including the the constitutional state, political regime and political system.

Political Economy I

1.Levar os alunos a pensar a realidade económica que está subjacente a todo o comportamento humano. É urgente que cada aluno compreenda a razão pela qual e como é construído o conhecimento cientifico( em particular da ciência económica); 2. Levar os alunos a compreender o melhor possivel, a realidade económica que preenche o quotidiano de cada homem e, portanto, do futuro licenciado em Direito; 3. Levar os alunos à produção de um discurso correto sobre a ciência económica. É fundamental não confundir o discurso de senso-comum com o discurso da ciência, quando e onde for necessário explicar fenómenos económicos ( uma das vertentes da explicação global dos fenómenos humanos). É objetivo da disciplina de ECONOMIA POLITICA I, preparar de cada aluno para uma exercitação permanente da inteligência, com recurso à memória apenas como ferramenta de apoio. A complementaridade deste exercicio deverá ser expendida em ECONOMIA POLITICA II.

Providing them an adequate learning of the essential content of Roman Law History and of Iberian Law History, till the end of Roman presence, unavoidable cultural foundation, due to the Global and European context of juridical institutions.

Introduction to Law I

The aim of this discipline is to provide the students with the basic frameworks and concepts of the legal system, with special focus on the portuguese one.
It is meant to see Law as a body in motion and not an estatic one, so major relevance is given to the methodological issues.
It is also meant to favour the development of reading.
The objectives ofhis course are articulated with Introdução ao Direito II.

Constitutional Law II

Following the aims and skills supposed to be the outcome of 'Direito COnstitucional I', 'Direito Constitucional II' develops the subjects of the constitutional activity of the State and the systems of the quarantee of constitutionality.

Public International Law

The main objective in this course is to teach the students the fundamental issues of public international law. It is also intended to make the students aware of some of the challenges that the present international reality poses to 'classic' international law.

Political Economy II

This discipline is based on economics and allows the students to understand: - The intervention of the government in the economy and the associated juridical consequences; - The interaction between public economics and politics and its influence on colective choice. - The links that embody individual choice and colective choice and the shape of institutions. - International economic relations within a globalized world; - The economic approaches to international trade, enhancing the gains from the opening of economies; - The payments among nations and the foreign exchange market; - The international movement of labour and capital and the mechanisms of economic integration and the appearing of trade blocs.

Administrative Law I

Administrative Law I – a subject of the 2nd year of the degree in Law – studies the Administrative Law in general. The program develops the following major points: an approach to the notion of public administration, administrative law, administration systems, genesis and development of Administrative Law. The discipline has also to deal with and to explain the administrative organization.

European Union Law

D212 - ECTS

This course introduces the study of the EU law. It focuses, first, on the objectives, the dynamics of the integration process, the basic principles, the competencies, the institutions, the decision-making procedures and the european legar order, its respective legal acts and the relation with the Member-States legal order and the international legal order. Secondly, in order to help students in developing a critical awareness of the political significance of the EU, a brief description of the various political theories, that since the beginning of the process try to capture this reality, will be presented.

General Theory of Civil Law I

D201 I - ECTS

This subject, offered during the 3rd semester of the degree, aims at introducing the main legal framework governing Private Law. It prepares the students to the forthcoming subjects within the Private Law field, such as: Law of Contracts, Obligations (other sources besides contract; Civil Liability), Property Law, Family Law, Succession Law, etc. It is focused mainly on the analysis of the First Part of the Portuguese Civil Code (1966), and special effort is done so that students become aware of the Fundamental Principles governing Private Law (eg. Private Autonomy, Civil Liability, Reliance Principle, etc.) and grasp the central role played by "the person" in the (Private) Law.

Administrative Law II

D208 I - ECTS

The program will take a close look at and study the scope of administrative jurisdiction, the organization of administrative courts and how they operate and the respective legal procedure. Since this is a reform we are referring to, it is worthwhile and necessary to start with a dogmatic construction that sheds light on and increases understanding of the topics to be discussed. Special attention will be given to studying special administrative action and the string of new questions regarding the object of the administrative procedure, legitimacy and carrying out of sentences. Because administrative justice is guided by the principle of full and effective jurisdictional protection, it is extremely relevant to understand the role played by administrative judge, as well as the proof, namely in the provisional measures

Fundamental Rights

This discipline aims to give the students the appropriate tools to understand

Fundamental Rights in different dimensions: the general theorectical basics,

their presence at the Portuguese Constitution and International Declarations,

and their living as law in action in the present moment.

General Theory of Civil Law II

D209 II - ECTS

The subject Teoria Geral do Direito Civil II (Private Law: General Theory II), offered during the 4th semester of the degree, works with the central concept, to the Portuguese Private Law, of “negócio jurídico” (including both contract and unilateral promise of the Common Law). In substance, it introduces the framework of Portuguese Contract Law regarding formation, content and invalidity. “Culpa in contrahendo”, reliance principle and enforceability of promises are also carefully considered, given they are neighbor institutes with strong connection to contract. Finally, special attention is also paid to the study of representation (legal action on behalf of the principal).

Provide the students with a thorough knowledge of the initial part do the Law of obligations (concept, structure and function of the obligation, as well as its sources). We also aim, besides teaching the subject matter, to contribute to the development of the students capacities of legal reasoning.

Labour Law I

Objectives: to supply a first contact with the basic notions of commercial portuguese law, namely in the ambit of the industrial property, bill of exchanges and insolvency law.

Family Law and Inheritance Law I

D401 I - ECTS

It is intended that students should acquire solid and deep knowledge of the legal regime applicable to family legal relations and their equivalent (specially to de facto union). It will be paid special attention to the constitution of matrimonial relations and to its personal and patrimonial effects It is also intended that, whilst learning the material that will enable them to soundly resolve the various real-life cases which come under its jurisdiction, students will also develop their powers of reasoning, as young jurists. It will also be provided information about important judicial decisions.

Private International Law I

The Course on Private International Law (PIL) will present the problems arisen out of the existence of pluri-localized relationships and of the necessity to provide for its regulation, giving an overview of the used methods and the solutions found for such problems.

Civil Procedural Law III

Civil Procedure III aims to provide both a theoretical and practical perspective of the law on the enforcement of civil judgements and other enforceable titles in the Portuguese courts.

Philosophy of Law and Legal Methodology I

The discipline of Methodology and Philosophy of Law (Jurisprudence) aims at an understanding of Law at a level beyond the strictly technical, having as its object the acquisition, by students, of critical tools indispensable for autonomous reflection upon this institution, which is at the same time attentive to its ethical, political, and general cultural dimensions. This openness to different concerns, as well as being a touchstone of university study in general, is vital to the education of jurists, who ought properly to be more than mere technocrats: as is often said (to borrow a canonical sentence) “He who knows only the Law, knows not even the Law itself”. Not only is it our purpose, therefore, to sketch a general outline of a number of topics selected from various areas of methodological and philosophic law, but also to open up an interdisciplinary dialogue between juridical thought and other modalities of thought and culture, as well as promoting personal and group research at a deeper level than has been made so far.

Administrative and Tax Law Procedure

DO409 - ECTS

In this subject will be under intent comment and study the scope of the administrative and tax jurisdiction, the organization and functioning of the administrative and tax courts and how they operate and the respective legal procedure. Special attention will deserve the study of the jurisdictional means and the string of questions regarding the object of the administrative procedure and legitimacy. In a justice guided by the principle of the effective and full jurisdictional protection, it will be of enormous relevance to perceive the role played by the judge, as well as the proof, namely in the provisional measures.

Private Contracting

DO413 - ECTS

The Private Contracts course is an option taught in the second semester of the forth grade of the First Degree in Law at the FDUP. Its aim is to complement the knowledge already acquired in the subjects taken in the General Theory of Civil Law and the Law of Obligations, in the sphere of civil and commercial contracts. The course is divided into two main parts, namely, the contracts law in general, and the special contracts law. The contracts studied in this second part are those of sale, lease and sub-contracting.

It will be given information about important judicial decisions.
