Objectives

It is intended that students should acquire solid and deep knowledge of the juridical regime applicable to establishment of affiliation and its effects (law of affiliation) and to the post-mortem destiny of the de cuius`juridical relations . (Inheritance law). It is also intended that, whilst learning the material that will enable them to soundly resolve the various real-life cases which come under its jurisdiction, students will also develop their powers of reasoning, as young jurists. It will be given information about important judicial decisions.

Learning outcomes and competences

Students must be able to determine, analyze and understand the legal regime of family relationships and of mortis causa succession and aply those regimes to real life situations.

I - LAW OF AFFILIATION 1. Affiliation as a legal and social problem. The moment of conception. Artificial reproduction technologies. 2. Establishment of affiliation: maternity and paternity. 3. Effects of affiliation. Name. Reciprocal rights and duties. Paternal authority. II - INHERITANCE LAW 1- Notion and justification for succession phenomenon. 2- Concept of succession. Succession in life and succession through death. Succession as translative derivative acquisition. Reference to sharing in life. 3- Kinds of succession mortis causa. 4- Death as presupposition for succession. Simultaneous death and presumed death. 5- Opening of succession. Concept, time and place. 6- Title to inheritance. Concept. 7- Acquisition by inheritance. 8- Division of inheritance.

Teaching methods and learning activities

The theoretical classes provide a systematic presentation of all the material in the programme with use of examples and references to jurisprudence pertaining to each issue and. At practical classes will be analyzed and resolved real-life cases, usually chosen from amongst the most significant jurisprudence in our courts.
