In the terms nº 1 of article 51º of the “Código da Propriedade Industrial” a technology will be considered for patent if the it is original, innovative and can be applied to industry. In practice, a patent gives its applicant the exclusive right to produce and commercialize the technology or process but subsequently the technology is of public domain.
The University of Porto agrees with the protection of R&D output through the form of patents as this reinforces the universities internal/external image as well as emphasizing its level of innovation. The protection and added value given to patents will allow them to be a source of capital as well as becoming the property of the University, and in turn they will be a measure of the productivity of the universities academics, when related to the capital obtained from the commercialization of this knowledge.
