Objectives
The study of the system of regional international protection of human rights established by the Council of Europe through the European Convention on Human Rights, as well as its articulation with the Portuguese legal system and the legal system of the European Union.
Learning outcomes and competences
Students should be familiar with the ECHR, its system of judicial protection and understand the principles and conditions of its articulation with the Portuguese and European Union legal systems, including fundamental case law. They should be able to critically evaluate real and hypothetical situations in which the ECHR can be applied.

I. Seminar "The Council of Europe and the protection of human rights" (Anabela Costa Leão)
1. International and regional protection of human rights. The role of the Council of Europe. 2. European Convention on Human Rights (1950)
- Scope of protection
- Interactions between the Convention, national catalogues and EU protection
3. The European Court of Human Rights
- Composition, jurisdiction e competences of the Court;
- Individual applications;
- Decisions of the Court and execution;
- Adjudication and the margin of appreciation;
- The case-law of the court - discussion;
4. Other instruments and mechanisms of protection (brief mention)
II. Seminar "Responsibility for violation of regional international law" (Juliana Ferraz Coutinho)
1. The internationalization of administrative law
2. The role of the legislator, Public Administration and national courts
3. Responsibility for violating regional international law
4. Article 6 of the European Convention on Human Rights and the duration of the administrative procedure: quid iuris?
III. Seminar "The European Convention on Human Rights and European Union Law" (Graça Enes)
1. The jurisprudential recognition of ECHR rights as general principles of Community law.
2. The normative recognition of the ECHR and its articulation with the Treaty on European Union and the Charter of Fundamental Rights.
