Objectives

The European Union and its Law are now one of the key tables where public power takes place, involving Member States and citizens. In this area of specialization the study of fundamental principles and institutes of EU law and its main policies are essential, whether from the scientific perspective of legal research, both in the perspective of the professional skills of lawyers. The syllabus run multiple substantive dimensions of EU law and deepen critically the respective developments, with attention to key issues and problems both at the dogmatic plan, and also practical, thus ensuring the accomplishment of the curricular unit’s objectives.
General overview of the nowadays doctrine on the studied themes. Deepening theoretical and dogmatic basis of those themes, as well as its projections on the legal regulation and jurisprudential solutions. Promoting an autonomous and critical reflection on the main problems of European Union Law and its interaction and projection on national legal orders and on international law - identity and values and the digital revolution.

Learning outcomes and competences

Students should be able to understand rigorously dogmatic concepts and institutes of European Union law, understand and critically analyze the regulatory and jurisprudential bases, being able to develop an autonomous research and solve real situations that professional practice requires.

1. The constitutionalization of European integration.

1.1. Principles, procedures and institutes of the European legal federalism.

1.2. The institutional dimensions of European constitutionalisation.

2. EU Law in face of present challenges - test studies.

2.1 The regulatory challenge of identity: common and plural?
2.1.1. The legal protection of national identity.
2.1.2. The identity of the Union: values, principles and institutions.

2.2. The digital challenge (part of Jean Monnet Module "DigEUCit. A Digital Europe for Citizens. Constitutional and Policymaking Challenges" - Erasmus+ Project 101085671).

Besides the mentioned bibliography other suggestions will be given on classes.

Teaching methods and learning activities

The lectures will consist of theoretical-practical classes, which include a first exposition about each theme (carried out by the teacher or one of the students), followed by discussion and a conclusive synthesis of the positions being discussed.
This teaching methodology provides the students with essential knowledge on the studied themes, thus enhancing their capacities of a critical reflection and preparing them to the coming writing of their masters’ thesis.
On the other hand, evaluation through the multiple components indicated is an appropriate and serious means to verify the knowledge and skills acquired and the personal reflection work of the students
