Objectives

The Curricular Unit aims at providing the students with specific and specialized knowledge concerning the relations between Sports and Law. The main purpose is to bring Sport closer to the existing laws and regulations published either by the Government or by private entities that condition the access to, the development and sometimes the outcome of the sports practice. Another purpose is contributing to clarify the difference between different types of sport namely professional and non professional, top level and recreational sport or for rehabilitation, not to mention school sport. Therefore, the students will improve skills of interpretation and analysis of the sports legislative reality, acknowledging it as a space of legal plurality. At the same time, they will have the opportunity to begin identifying and understanding the legal and sporting organization of the major public and private entities, which are directly and indirectly related to sport.

Program

1. The Sport and the Law, and the right to Sport.
a. References to sports doctrine, jurisprudence and legislation.
b. Striking periods of State interventions in sport.
2. Introduction to the hierarchical legislative building.
a. Implied and express mentions to sport in the Constitution of the Portuguese Republic.
b. Framework Law of sports system and disperse legislation – history and formal and substantive analysis of the main legislation.
3. Primary analysis of the organization and operation of the Portuguese Sports System according to the existing legislative tools.

Teaching methods and learning activities


Expository method toggling between conceptual approaches and the promotion of debates and presentations by the students. The target is to create an interactive environment in the classroom that helps the students to reflect and discuss on the intersection between sports reality and legislative reality, focusing on practical, more evident and media covered cases.
