Objectives

Deepen and update the knowledge already acquired by students on the regulation of international legal relationships (conflicts of laws, conflicts of jurisdictions, limits on the application of foreign law, recognition of foreign acts) now considering family and succession relationships and their regulation, in particular by rules of European Union PIL. Develop and encourage the interpretation and critical analysis of both legal solutions and their interpretation and application by the courts.

Learning outcomes and competences

It is intended that master's students attain a profound knowledge of the legal regime applicable to family and succession property relations, considering its international dimension, and be able to problematize and critically analyze certain aspects of this regime.

I. Introduction. 1. The legal relevance of international (or transnational) family and succession relationships. 2. Conflict of laws and conflict of jurisdictions. 3. The “Europeanization” of private international law in matters of family and succession relationships and its coexistence with domestic private international law. 4. The limits to the application of foreign law: ordre public and overriding mandatory provisions.

II. International marriage and de facto union. 1. Issues of formal and substantive validity. 2. Personal and patrimonial effects. 2.1. Analysis of Regulations (EU) 2016/1103 and 2016/1104, of the Council, of 24 June 2016.

III. The international maintenance obligation. 1. Analysis of Regulation (EC) 4/2009, of 12.18.2008.

IV. International divorce and separation. 1. Analysis of Regulation (EU) 2019/1111, of the Council, of 26.06.2019 (“Brussels IIter”). 2.Analysis of Regulation (EU) 1259/2010, of the Council, of 20 December 2010 (“Rome III”).
