Objectives

- To provide students with the essential frameworks of the criminal procedural law;
- Identifying and understanding the various procedural models, their fundamental characteristics and their estrutural principles;
- Deepening theoretical and dogmatic foundations of the studied themes, as well as its projections in terms of legal regulations and jurisprudential solutions;
- Promoting a critical and autonomous reflection on central criminal procedure themes.

Learning outcomes and competences

Studentes should be able to:
- identify the essential frameworks of the criminal procedural law;
- understand the main procedural models and identify their fundamental characteristics;
- have a thorough knowledge of the Portuguese criminal procedure model and its structuring principles;
- discuss critically the legal and jurisprudential solutions to the central problems of criminal
procedure.

Lectures: Presentation and analysis of the syllabus, using real examples to apply the concepts. Practical sessions: Solving practical cases (hypothetical and based in case law); answering questions.

Eligibility for exams

Attending at least 75% of the classes is mandatory.

Calculation formula of final grade

Final Grade = 0,60xFE + 0,43xWA + 0,10xOP

FE = Final exam

WA = Written assignment

OP = Oral Participation

NOTE:

Regardless of whether the student is assessed in the normal or appeal period, to complete successfully this course, students are required to:

a) Attend, at least, 75% of the classes, and participate effectively in class discussion (OP);
b) Take the written Final Exam (EF) and complete an Written assignment (WA), which shall be oraly presented and defended in class;
b) Obtain a minimum classification of 8/20 points in each evaluation component (EF, WA and OP);
c) Obtain a Final grade of no less than 9,5 points in a twenty points scale.

Examinations or Special Assignments

The evaluation in the curricular unit is comprised of the compulsory accomplishment of a written assignement, that must be submitted by the end of the semester (the due date will be timely scheduled with the students).

At the beginning of the semester, the formal rules, the methodology and the deadlines to be met by the students in carrying out the assignement are disclosed.

The assignement is COMPULSORY, so the classification obtained in this distributed component is considered in the determination of the final evaluation classification in the two evaluation periods (normal season and resource season).
