Objectives
- Provide an overview of current doctrine on specific and controversial topics of criminal evidence;
- Deepen the theoretical and dogmatic bases of the studied institutes, as well as their projections in terms of legal regulation and jurisprudential solutions;
- Promote autonomous and critical reflection on central problems of the criminal procedure.

Students should be able to:

- discuss critically the legal and jurisprudencial solutions to the central problems of criminal procedure.

Program
1. General framework: evidence and truth; legality of evidence and atypical means; analytical decomposition of the evidence procedure.
2. Exclusionary rules and Beweisverbote; the fruit of the poisonous tree doctrine and its exceptions; evidence unlawfully obtained by individuals.
3. The accused as a source of evidence and the principle "nemo tenetur se ipsum accusare": the right to silence; the probatory value of statements by the accused and the co-defendant; projections of the right not to self-incrimination in other means of proof and obtaining evidence (examinations, searches and expertise; determination of genetic profile; lineup identification; reconstitution of the fact; taking of autographs and comparison of handwriting; delivery of documents and coercive disclosure of passwords).
4. The challenges of electronic evidence: the means of proof in the digital environment versus the traditional means of investigation; computer searches, seizure of computer data, seizure of e-mail and other telecommunications intrusions, environmental wiretapping, undercover agents wistleblowers, the use of malware in criminal investigation.
5. The transnational circulation of evidence: the transnational criminality; the international judicial cooperation and in the space of the European Union; the EIO.
