Objectives

This course aims to cover three specific areas of public international law and international relations: global governance, international commercial contracts and international criminal law.

Learning outcomes and competences

Stronger knowledge of these core issues of Public International Law, and a greater capacity for understanding some of the most central issues of contemporary international relations.

PART I - INTERNATIONAL COMMERCIAL CONTRACTS

1 - The discrepancy of national laws as an obstacle to the international commerce.
2 - The role of the United Nations in the promotion of legal harmonization of international commerce: the United Nations Commission on International Trade Law (UNCITRAL):
2.1 - Origins, organization and purposes of UNCITRAL;
2.2 - UNCITRAL´s techniques for the promotion of legal harmonization;
2.3 - Case study: the United Nations Convention on Contracts for the International Sale of Goods (CISG).
3 - The role of the International Institute for the Unification of Private Law (UNIDROIT) in the promotion of legal harmonization of international commerce:
3.1 - Origins, organization and purposes of UNIDROIT;
3.2 - UNIDROIT´s techniques for the promotion of legal harmonization;
3.3 - Case study: the UNIDROIT Principles of International Commercial Contracts (UPICC).

PART II - INTERNATIONAL CRIMINAL LAW

1. International Criminal Law and Criminal International Law.
2. The Rome Statute (1998) and the creation of the International Criminal Court (ICC).
2.1. Origins and importance.
2.2. General principles of the Statute.
2.3. Special problems of spatial criminal law application.
2.4. Analysis of the main criminal offences and its penal consequences.
2.5. The Statute's transposition to the Portuguese criminal law.
2.6. Articulation problems of the Statute with the national cooperation law on criminal matters (Law nr. 144/99, August 31st).
2.7. Brief reference to the European arrest warrant.
