Objectives

Criminal procedure themes:

- A general overview of nowadays doctrine in the themes of evidence, procedural acts and legal remedies;
- Deepening theoretical and dogmatic foundations of the studied themes, as well as its projections in terms of legal regulations and jurisprudential solutions;
- Promoting a critical and autonomous reflection on central criminal procedure themes.


Criminology’s themes:

Part one of the syllabus aims at studying the current status of the discipline, in its fundamental and applied fields; identifying the main propositions of nowadays’ theoretical paradigms and its implications on the level of criminological investigation.
In the second part of the syllabus, one aims at specific objects of criminological knowledge and investigation: the “white-collar crime” and restorative justice, in a victim-centred perspective and in its relationship with Victimology’s developments.

Learning outcomes and competences

Criminal procedure themes:

Studentes should be able to:
- know deeply the current state of the doctrine in the themes of evidence, procedural acts and legal remedies;
- discuss criticaly the legal and jurisprudencial solutions for the central criminal themes.


Criminology's themes:

Students should be able to:
- know the current state of Criminology;
- identify and reason about theoretical paradigmes of curent Criminology;
- identify and reason about main issues on criminological research, separating it from judicial investigation;
- know Criminological work on white-collar crime;
- know Criminological and Victimological work on restorative justice.

Themes on Criminal Procedure:


A. Criminal evidence theory: the evidence and the truth, the exclusionary rules, the evidence proceedings, evidence means and obtaining the evidence means.


B. Procedural acts theory. Acts unworthy value: procedural invalidities.


C. Legal remedies’ theory.




Themes on Criminology:

A. Introduction to the study of Criminology and its main theories: historical developmens and current theores: bio(socio)logical. +personaliy and sociological theories, labelling and social control.

B. White collar crime


1. The nature and features of white collar crime and explanatory theories


2.Market failures and opportunity for economic and financial crime


3. Institutional anomie and white collar crime

C.Restorative Justice and Victimology.
