Objectives

The main scope is to give a high-level case management skills and a repertoire of knowledge in portuguese, european and comparative civil procedure law.

Learning outcomes and competences

To give Students a cientific background and a conscious feeling that allows them to keep in pace with new challanges brought by quickly changing problems arising from some recent conceptions about judicial (adjudicative) and non judicial (mediation, arbitration) methods of dealing with social conflicts.

Recent developments (legislative and jurisprudential) on national civil procedural, EU and comparative law.

Forms of action in civil litigation. Provisional remedies. Freezing injunctions. Reversal of procedural burden. Allocation of cases to separate tracks. Addition removal and substitution of parties. Non-contentious proceedings.  Alternative dispute resolutions. Mediation; legal framework. EU directive on mediation.  Arbitration; arbitration Act 2011. Judicial case management; reasoning in case management decisions. Principles of civil litigation; inquisitory and adversary procedural systems. Pre-trial active management during the preliminary hearing. Legal standing; derivative suits. Affirmative defense in civil cases: foundations and difficulties. Set-off; counterclaim. Brussels I Regulation (recasted). Primacy of Union Law over internal legal systems.
