Objectives
The aim of this discipline is to provide the students with the basic frameworks and concepts of the legal system, with special focus on the portuguese one.
It is meant to see Law as a body in motion and not an estatic one, so major relevance is given to the methodological issues.
It is also meant to favour the development of reading.
The aim of the second part is to know and understand the fundamental frame and elements that constitute the legal order, focusing mainly on the portuguese one and with a practical approach.
Learning outcomes and competences
Students must know and understand the fundamental general questions of Law as a legal order, system and as a science. Students should understand the relation between Law and the other normative orders and social spheres. Students are supposed to understand the main conceptual frames of the portuguese legal system and the fundamental lines of western legal thinking.
Students should understand the theory of the legal norm and legal method. Knowledge of the sources of law is also mandatory, according to the classical perspective but also its critique in favour of a plural perspective. Legislative techniques and also the problems concerning conflicts of norms should be understood, showing the capacity to solve cases.
