Objectives


The aim of this discipline is to provide the students with the basic frameworks and concepts of the legal system, with special focus on the portuguese one.
It is meant to see Law as a body in motion and not an estatic one, so major relevance is given to the methodological issues.
It is also meant to favour the development of reading.
The objectives ofhis course are articulated with Introdução ao Direito II.

Learning outcomes and competences

Students are demanded to know and understand the fundamental general questions of Law as a legal order, system and as a science. Students should understand the relation between Law and the other normative orders and social spheres. Students are supposed to understand the main conceptual frames of the portuguese legal system and the fundamental lines of western legal thinking.

I - The meaning of law ('quid ius'). Preliminary framework.
1 - The Human Being, Society and Law
2 - The law as a normative, institutional and axiological system. Legal science, science of law and auxiliary sciences of law. The auxiliary sciences of law


II - The meaning of law ('quid ius'). The legal science as a normative ordend science.
1 - Comparison with other normative orders, in particular Ethics.
2 - Law, Authority and Power. The issue of coercion. The relation with the State and Economy.
 

III - Law and rights.
1 - Law and righ.

2- The national legal order, the international legal order, the EU legal order.

3 -Public and Praivate Law. Fundamental principles.

4 - Validity. Enforcement and effectiveness.

5 - Implementation of law and rights


IV - The meaning of law ('quid ius'). Spacial path space: the legal systems of the world.


 
V - The meaning of law ('quid ius'). Historical path. The history of Western legal thought.
