Objectives

GROUP A
1. To develop a critical attitude in law students, instilling in them the kinds of knowledge and methods to determine the creative activity of thinking.
2. To locate legal thought in relation to the major systems of thought.
3. To identify the paradigms and large issues of the philosophy of contemporary law.
4. To create mechanisms for self-learning and personal development to permit students to take possession of their legal experience.

Group B
This program aims to question the Law, to consider it beyond the strictly technical domain, helping students to acquire the essential critical tools for the exercise of autonomous reflection, sensitive to the general dimensions of ethical, cultural and value judgments.
This opening up to other concerns, besides being the touchstone of university studies, is vital to the training of a lawyer, who must be more than just a technocrat: he/she is, as has been said before (paraphrasing mutatis mutandi a timeless formula “he who only knows Law, not even the Law knows”.
So the aim is not only to outline a panorama of topics nurtured in many varied areas of legal-philosophical and methodological spheres of reflection, but also to open a dialogue of legal knowledge with different manifestation of thinking and culture, and, further, to encourage personal and group research at a deeper level. That is the specific function of the research topics of program (B), which, the acquisition the theoretical bases (A), ought to be focused on, especially, in the theory-practical classes in the second semester.

Teaching methods and learning activities

The combination of theorical and practical classes permits a valuable interchange between theoretical and practical knowledge, and is thus an important part of the learning process, giving the student the chance to experience and ponder in a more considered and thorough way the knowledge that has already been imparted to him/her.

It is meant for the students to practise in-depth and thorough research, texts’ dissection, conceptual reasoning from a comprehensive perspective and critical comments and suggestions.

Evaluation Type

Eligibility for exams

The marks the student must get have to be equal or higher than 10, in a scale of [0,20] in one of the following hypotheses:
a)Average between the two examinations (“frequencies”);
b)Oral examination (if the student obtained in a) a mark between 7 and 9);
c)Written final examination;
d)Oral final examination (if the student obtained in c) a mark between 7 and 9.

Calculation formula of final grade

Are the marks obtained in the examinations referred in “Frequency Attaining” a), b), c) or d).

Abundant bibliographical references can be found in Lições Preliminares de Filosofia do Direito organised by topic which, brevitatis causa, we cannot mention here. The lecturer will recommend other works, specific to each point of the program, during the course of classes.
