Foundations of Constitutional Law and Constitutional Globalization

This curricular unit aims to relate historical, philosophical and theoretical foundations of General Constitutional Law with the new paradigmatic and practical challenges of constitutional globalization, and especially to work on the project of an International Constitutional Court.



 

Learning outcomes and competences

In addition to mastering the syllabus, students should be capable of research and exposition work, trained during the seminars, and capable of writing adequate articles, monographs, etc.

State of the Art of Constitutional and Prospective Law. New Legal and Constitutional Paradigms.

1.Interconstitutionalities and Multilevel Constitutionalisms

2. Anti-international sovereignties, "souveranismes" and prejudices

3. Constitutional internationalization, globalization vs. totalitarian (the theme of the "World State")


III. The Draft of an International Constitutional Court - special issue.

1. Democratic Right and Humanistic Fraternal Law

2. International Constitutional Law

3. An International Constitutional Court: philosophy, history, challenges, achievements. Analysis of the project.
