Objectives

PURPOSES

The discipline is structured athwart: it aims at letting know in an articulated way, the principles and fundamental concepts of the constitutional Economic Law (with special incidence in the fundamental economic rights), of the economic administrative law and of the communitarian economic law.

Program

PROGRAMMATIC CONTENTS

I – Introduction. 1. Economic Legal Grounds. 2. Historical development. II–The Portuguese Economic Constitution. 1. The fundamental principles of the economic organization. 2. The fundamental economic rights. III – The government intervention in the economy. 1. The direct intervention. 1.1. The public business sector. 1.2. Companies that suffered a government intervention, a collective appropriation and nationalization. 2. The indirect intervention. 2.1. The economic regulation. 2.2. The creation of substructure, the planning and the economic furtherance. IV – Defense of competition and the free circulation. 1. The defense of competition in the Portuguese law and in the communitarian law. 2. The fundamental communitarian freedoms. 3. The communitarian rules of the competition. 4. The national rules of the competition.
